These Terms of Service ("Terms") govern your access to and use of www.dmtcconsultingllc.com and your purchase of products from

DMTC Consulting LLC ("DMTC," "we," "our," or "us").

By browsing our website, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the

site or purchase from us.

 

1. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase from us. By placing an order you confirm that you meet these requirements and that the information you provide is accurate and complete.

If you are purchasing on behalf of a business, farm, or other entity, you confirm you have authority to bind that entity to these Terms.

2. Products and Descriptions

We sell livestock nutritional supplements, mineral products, tubs and blocks, and topical animal-care products. We work to describe our products accurately, including ingredients, guaranteed analysis, and feeding directions.

Product images are provided for illustration. Packaging, container style, color, and label design may change over time.

Minor variation in appearance, texture, granulation, or color between production batches is normal for mineral and botanical products

and does not indicate a defect.

We reserve the right to modify, improve, reformulate, or discontinue any product at any time without notice.

3. Availability, Pricing, and Errors

All products are offered subject to availability. We may limit quantities, restrict sales, or decline orders at our discretion.

Prices are stated in United States dollars and do not include shipping, handling, or applicable taxes unless expressly stated. Prices are subject to change without notice; the price that applies to your order is the price displayed at the time your order is confirmed.

Despite our efforts, our website may occasionally contain errors in pricing, descriptions, availability, or images. We reserve the right to correct such errors and to cancel or refuse any order placed on inaccurate information, even after an order confirmation has been sent.

If we cancel an order for this reason and you have already been charged, we will issue a full refund.

4. Orders and Acceptance

Your submission of an order is an offer to purchase. Our order confirmation email acknowledges receipt of that offer but does not

constitute acceptance. A contract is formed only when we ship the product to you.

We may decline or cancel any order, including where we suspect fraud, where a product is unavailable, where a pricing error has occurred, or where we cannot verify the delivery address or payment details.

5. Payment

Payment must be received in full before an order is shipped. We accept the payment methods displayed at checkout. By submitting payment information you represent that you are authorized to use the payment method.

Applicable sales tax is calculated and applied at checkout based on the shipping destination.

6. Shipping, Delivery, and Risk of Loss

We ship within the United States. Orders are typically processed and dispatched within a reasonable timeframe after payment clears. Delivery estimates are estimates only and are not guaranteed.

Title and risk of loss pass to you when the carrier takes possession of the shipment. We are not responsible for delays, damage, or loss caused by carriers, weather, or other circumstances outside our control. Where a shipment is lost or damaged in transit,

we will assist you in filing a claim with the carrier.

You are responsible for providing an accurate, complete, and deliverable shipping address. Additional charges arising from an incorrect address, refused delivery, or repeated delivery attempts may be passed on to you.

7. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms. Please review that policy before purchasing. In the event of any inconsistency between these Terms and the Return & Refund Policy on the subject of returns,

the Return & Refund Policy controls.

8. Product Use, Storage, and Safety

Our products are formulated for livestock and agricultural use only. They are not intended for human consumption.

You are responsible for:

  • Reading and following all label directions, feeding rates, mixing instructions, and cautions

  • Selecting products appropriate to the species, age, class, and condition of your animals

  • Storing products in a cool, dry, covered location, protected from moisture, heat, direct sunlight, pests, and contamination

  • Keeping products away from children and non-target animals

  • Observing any applicable withdrawal periods for animals intended for meat or milk production

  • Complying with all federal, state, and local regulations that apply to your operation

Improper storage, over-feeding, mixing errors, or use contrary to label directions can harm animals and voids any claim relating to 

product performance.

9. No Veterinary Advice

Information on our website, in our product materials, in videos, and in conversations with our staff is provided for general informational purposes only. It is not veterinary advice, diagnosis, or treatment, and it is not a substitute for consultation with a licensed veterinarian.

Always consult a licensed veterinarian or qualified animal nutritionist regarding the health, diet, and treatment of your animals,

particularly if an animal is sick, injured, pregnant, or receiving medication. If you have a veterinary emergency, contact your veterinarian immediately.

10. Regulatory Statement

Statements made about our products on this website have not been evaluated by the United States Food and Drug Administration.

Our products are nutritional supplements and topical care products intended to support normal biological structure and function.

They are not drugs, and they are not intended to diagnose, treat, cure, mitigate, or prevent any disease.

11. No Guarantee of Results

Results vary between operations. Animal performance depends on many factors outside our control, including genetics, base ration,

forage quality, water quality, stocking density, climate, herd health, management practices, and the accuracy with which products are

mixed and fed.

and are not a promise, guarantee, or prediction of the results you will achieve.

12. Disclaimer of Warranties

13. Limitation of Liability

To the fullest extent permitted by law, DMTC Consulting LLC, its owners, officers, employees, and suppliers shall not be liable for any 

indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost production, loss of animals,

loss of business opportunity, veterinary costs, or damage to reputation, arising out of or relating to your use of our products or website, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to any product or order shall not exceed the amount you actually paid for the product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. Where that is the case, the above limitations apply to the fullest extent permitted by law, and nothing in these Terms excludes liability that cannot lawfully be excluded.

14. Indemnification

You agree to indemnify, defend, and hold harmless DMTC Consulting LLC and its owners, officers, employees, and agents from any claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising from your misuse of a product, your failure to follow label directions or storage requirements, your violation of these Terms, or your violation of any law or the rights of a third party.

trade names, and page layout, is owned by DMTC Consulting LLC or its licensors and is protected by United States and international intellectual property law.

You may view and print content for your own personal or internal business use. You may not copy, reproduce, republish, distribute, sell, or create derivative works from our content, or use our name, logo, or trademarks, without our prior written permission.

16. Customer Reviews and Submissions

If you submit a review, comment, photograph, video, testimonial, or other content to us or about our products, you grant us a

non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, adapt, publish, and display that content in connection with

our business, including in marketing materials, without compensation to you.

Notify us immediately if you suspect unauthorized access. We may suspend or terminate an account that we reasonably believe has been compromised or used in breach of these Terms.

20. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters,

severe weather, fire, flood, epidemic, labor disputes, supply chain disruption, carrier failure, utility or internet outage, regulatory action, or acts of government.

21. Governing Law and Disputes

These Terms and any dispute arising out of them or out of your purchase are governed by the laws of the State of Ohio, without regard

to its conflict of law principles.

You agree that the state and federal courts located in Mercer County, Ohio have exclusive jurisdiction over any dispute, and you consent to personal jurisdiction and venue in those courts.

Before commencing formal proceedings, we ask that you contact us so we can attempt to resolve the matter directly. Most issues can be settled quickly and informally.

22. Severability and Waiver

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision is not a waiver of our right to enforce it later.

23. Entire Agreement

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and us regarding your use of our website and your purchase of our products, and supersede any prior understandings.

24. Changes to These Terms

We may revise these Terms at any time. The version in effect at the time of your order governs that order. Continued use of the website

after changes are posted constitutes acceptance of the revised Terms. The "Last Updated" date at the top of this page reflects the most recent revision.
